1. Agency Role & Limitation of Liability
Rainbow Concierge Service acts solely as an intermediary/agent for suppliers (cruise lines, hotels, airlines).
Supplier Responsibility: We are not responsible for breach of contract, intentional or careless actions, or omissions by suppliers that result in loss, damage, delay, or injury.
Assumption of Risk: By embarking on travel, the passenger voluntarily assumes all risks involved, whether expected or unexpected.
Hazardous Materials: U.S. law prohibits bringing hazardous materials (explosives, flammables, etc.) on aircraft. Violations can result in imprisonment and heavy fines.
2. Pricing, Quotes, and Surcharges
Occupancy & Fluctuations: Rates are typically per person based on double occupancy. Pricing and information are subject to change without notice. We reserve the right to adjust pricing in the event of errors or omissions.
Inclusions/Exclusions: Port charges are included for cruises unless stated. Airfare, taxes, transfers, and government fees are additional unless specified. Prices may change due to currency fluctuations.
Fuel Surcharges: Cruise lines reserve the right to re-instate fuel supplements (upwards of $9 per person, per day) if the price of crude oil reaches or exceeds $70 per barrel on the NYSE.
3. Travel Insurance (Strongly Recommended)
Travel insurance provides protection for cancellations, medical expenses, trip delays, and baggage loss.
Timing: We strongly recommend purchasing insurance within 10 days of your initial deposit. Most US health insurance does not cover expenses abroad.
Mandates: Some cruise lines require insurance for US departures. Rainbow Concierge Service is not liable if a cruise line requires insurance and you have declined it.
Waiver: It is understood that any traveler who has not purchased a policy has declined insurance.
4. Payments, Invoices, and Deadlines
Invoice Accuracy: The addressee is responsible for conveying information to all passengers. Passenger names must reflect full legal names as they appear on valid passports. Corrections may incur substantial fees and fare increases.
Payment Schedule: Please follow the schedule on supplier documents. We strongly encourage final payment 10 days prior to the actual due date.
Default: Failure to pay by the deadline may result in automatic cancellation by the supplier and forfeiture of deposits. Final payments may be applied to the credit card on file.
5. Cancellations and Refunds
Procedure: Cancellation requests must be submitted in writing. You must speak with a Travel Advisor; do not leave a voicemail to cancel.
Fees: Cancellations are subject to fees from both the supplier and Rainbow Concierge Service to protect agency revenue.
Refund Protections: If a passenger is not at fault and has not violated terms, sums paid will be promptly refunded unless funds were already remitted to a registered wholesale seller or carrier who has defaulted. In such cases, we will provide you with written bank records establishing the disbursement.
6. Documentation, Health, and Accessibility
Entry Requirements: It is the passenger’s sole responsibility to provide proper ID (Passport valid for 6 months beyond return), visas, and inoculations.
Eligibility: Past offenses (including DUIs) may restrict entry to certain countries. Verify eligibility with the destination's embassy.
COVID-19/Health: Travelers must stay up to date on supplier vaccination and testing requirements. Rainbow Concierge Service is not responsible if a traveler is denied boarding due to health protocols.
ADA & Fitness: The Americans with Disabilities Act (ADA) applies only within the U.S. Facilities abroad may be limited. All guests must ensure they are medically fit for their itinerary.
Pre-Registration: For cruises, complete pre-registration on the vendor’s website (e.g., Carnival, Princess) as soon as possible. Documents are typically available 30 days prior to sailing.
7. Force Majeure
Rainbow Concierge Service is not liable for failure to perform due to "Force Majeure," including but not limited to: severe weather, fire, natural disasters, war, terrorism, government orders, or pandemics. Refunds for these events depend on obtaining funds back from the suppliers.
8. Website Terms and Authority
Intellectual Property: All content on rainbowconciergeservice.com is protected by copyright. No logos, graphics, or HTML coding may be copied or retransmitted without written permission.
Authority: You warrant that you are at least 18 years of age and possess the legal authority to create a binding obligation. You are financially responsible for all bookings made under your name, including those by minors.
